The California Crime Victim Compensation Fund

The California Victims Compensation Board (CalVCB) is a financial benefits program for violent crime victims. The program covers any crime that causes “physical injury or a threat of physical injury to the victim.” Victims of sexual abuse, assault, DUI, human trafficking, online harassment, or elder abuse can be eligible for compensation through the CalVCB. Victims must file an application within three years of the crime and provide documentation, or at least a police report, that an offense occurred.

Victims must fully cooperate with law enforcement. The application process is complex, and working with an attorney can help you increase the likelihood of successfully obtaining assistance. Additionally, an attorney can help you understand your options related to obtaining a protective order for your safety. Victims can pursue one or more of the following types of compensation:

  • Medical expenses related to your injury
  • Lost income
  • Mental health counseling
  • Relocation expenses
  • Crime scene cleanup
  • Home security

Civil Court Options for Victims of Crimes

The compensation provided through the CalCVB may not cover all of a victim’s damages. Usually, compensation is somewhat limited. Instead of waiting to see what the state will pay for their damages, some crime victims pursue compensation based on what they’ve lost through a personal injury lawsuit. Several types of personal injury lawsuits may be available for victims of crimes, including premises liability cases, intentional torts cases, and employment-based lawsuits.

Your legal strategy will depend on who is liable for your injuries. For example, if an employer engaged in negligent hiring and a staff member assaulted a patron, the victim may be able to hold the employer liable. Victims can pursue several types of damages through civil lawsuits, including the following:

  • Past and future medical expenses
  • Lost income
  • Loss of future income
  • Property damage
  • Pain and suffering

Premises Liability Cases

Property owners are legally obligated to keep their properties relatively safe for guests and visitors. When a property owner provides inadequate security and an invitee becomes injured due to a violent crime, the victim may be able to hold the property owner liable. For example, suppose gaps in perimeter fences, burned-out lights, or lack of security cameras and personnel contributed to a resident in an apartment complex being assaulted.

If the owner knew or should have known that an assault was reasonably foreseeable and failed to take precautions to prevent it, the victim could hold the property owner liable. Premises liability claims can be complex, and the sooner you speak to an attorney, the more time your attorney can spend investigating and gathering information.

Wrongful Death Lawsuits Arising from Violent Crimes

Violent crimes can lead to one or more victims’ deaths. Murder, negligent homicide, manslaughter, and vehicular manslaughter can all lead to preventable deaths. If you have lost your loved one due to a violent crime, nothing can bring your loved one back. At the same time, pursuing compensation through a wrongful death lawsuit may help you and your family cover expenses related to your loved one’s death. Plaintiffs in wrongful death lawsuits can pursue compensation for their loved one’s medical expenses before death, funeral costs, loss of consortium, and loss of future income.

If you’ve lost your loved one because of another person’s violent actions, it’s important that you discuss your case with an attorney. You only have two years from your loved one’s death to file a lawsuit. The compassionate attorneys at Saeedian Law Group will answer any questions you have and help you understand your legal options.
