Beach Boulevard runs the length of town as State Route 39. Neither is on the state's list of trauma centers. The most serious injuries go to UCI Medical Center in Orange, which UCI Health describes as the only Level I trauma center in Orange County, or to Orange County Global Medical Center in Santa Ana, a Level II center. Where you were taken matters later, because those records become the backbone of the damages claim.
The general deadline to sue for an injury in California is two years (Code of Civil Procedure § 335.1). That is not the deadline that hurts people in Westminster. The one that does is the six-month window to present a written claim to a public agency, which applies if a city street, a county road in Midway City, a state highway like Beach Boulevard, or an OCTA bus is part of the story. Common Causes of Westminster Injury Crashes
Freeway driving here changed recently. OCTA and Caltrans finished the I-405 Improvement Project in December 2023: 16 miles between SR-73 and the 605, one new general lane each way from Euclid Street to the 605, two 405 Express Lanes in each direction, and rebuilt overpasses, including the Magnolia Street bridge where Westminster meets Fountain Valley and Huntington Beach. More lanes and new toll-lane entry points mean more lane changes, and lane changes are where many freeway crashes start. On the surface streets, the patterns we look at most are these:
Walking in Westminster: Beach, Bolsa and Brookhurst
Beach Boulevard is the clearest example of why pedestrian cases here need care. In Westminster it runs about 3.5 miles from the 22 to Edinger and Heil, posted at 45 mph. An OCTA review for its Beach Boulevard Corridor Study counted about 22 pedestrian collisions and 25 bicycle collisions on that stretch from 2015 through 2018, and found the heaviest foot traffic at Bolsa Avenue. In December 2025 a walk audit along Beach between Westminster Boulevard and Trask Avenue, run through SCAG's Main Streets program with city, Caltrans and county staff, noted high speeds, people crossing at 20th Street where there is no marked crosswalk, missing lighting south of Trask, and a short walk signal for such a wide road.
Two points of law matter here. First, under California Vehicle Code § 275, a crosswalk exists at most intersections even when nothing is painted, and § 21950 requires drivers to yield to a pedestrian in it. A driver who hit you at an unpainted corner cannot simply say you were not in a crosswalk. Second, Beach Boulevard is State Route 39, so a claim that the road itself was dangerous, such as missing lighting or a signal timed too short, is presented to the state's Government Claims Program, not to the City of Westminster. A short stretch of Beach also passes through unincorporated county land, so for something like a missing sidewalk the responsible agency has to be checked for the exact spot. Sending the claim to the wrong agency can cost you the claim.
Bolsa and Brookhurst are city streets with heavy bus service: OCTA Route 64 runs along Bolsa and Route 35 along Brookhurst. If an OCTA bus was involved, the claim against OCTA follows the same six-month rule. For more on what pedestrians can recover, read can a pedestrian sue if hit by a car.
Who Can Be Held Liable in a Westminster Injury Case?
The driver is rarely the only name on a Westminster complaint. Who else belongs there depends on the vehicle, the road and what the driver was doing at the time:
Liable for careless driving: speeding, following too close, running a light or failing to yield.
Answers for its driver on the job, and for its own failures in hiring, training, hours-of-service or maintenance under federal rules.

Fault does not have to be all or nothing. California follows pure comparative fault (Li v. Yellow Cab), so a jury splits responsibility by percentage and your award drops by your share.
