Merced Truck Accident Lawyers
In Merced, truck traffic means State Route 99. The highway runs the length of the San Joaquin Valley through Merced and Atwater, and State Routes 59, 140 and 165 connect it with the rest of the county. A crash with one of those trucks is rarely a simple fender-bender, and the nearest trauma center is outside the county.
Saeedian Law Group represents people hurt in commercial truck collisions in Merced and throughout Merced County. Our offices are in Southern California, and we do not have an office in Merced. We work with Merced clients by phone, by video and through in-person visits when needed. You pay no attorney fee unless there is a recovery. Call (310) 288-3000 for a free case review.
Highway 99 and the Merced Area CHP
The California Highway Patrol’s Merced Area office, located in Atwater at 1500 Bell Drive, patrols about 43 miles of State Route 99, from the Stanislaus County line south to the Madera County line. The CHP says motorists in its area also travel State Route 59, State Route 165 and State Route 140, which leads toward Yosemite.
South of the city, State Route 152 links the valley to the Bay Area. At the Merced and Madera county line, Caltrans’s 2024 truck traffic table counts about 4,300 trucks a day out of roughly 15,900 vehicles. That means more than one vehicle in four is a truck, and about two-thirds of those trucks are five-axle tractor-trailers.
If your crash happened on any of those state routes, the CHP probably wrote the report. You can request it with form CHP 190 at the Atwater office or by mail.
Farm Trucks and the Hours-of-Service Rules
Federal rules normally cap how long a truck driver can drive. Under 49 CFR 395.3, a property-carrying driver may drive up to 11 hours after 10 consecutive hours off duty and may not drive beyond the 14th hour after coming on duty.
Agricultural hauling has an exception. Under 49 CFR 395.1(k), those hours rules do not apply during planting and harvesting periods, as determined by each state, to drivers carrying agricultural commodities within a 150 air-mile radius from the source, and to certain farm supply and livestock hauls. When a farm truck is involved, it is worth checking early whether the carrier relies on it.
The exemption does not make long hours safe, and it does not excuse a driver who was too tired to drive. It changes which records exist. When a farm truck is involved, we look at dispatch messages, weigh tickets, delivery times and phone records to reconstruct the driver’s day, rather than relying on a logbook that may not have been required.
No Trauma Center in Merced County
Merced County does not have a designated trauma center. A March 2026 report by the Central Valley Journalism Collaborative noted that the closest adult Level II trauma centers to Merced are Memorial Medical Center and Doctors Medical Center in Modesto, about 45 minutes north, and that Community Regional Medical Center in Fresno, about an hour southeast, is the only Level I trauma center in the San Joaquin Valley. The same report said Mercy Medical Center in Merced planned to seek a Level III trauma designation, a process that can take 18 months or more.
For an injured person, that distance shows up in the records. A crash victim may be seen first at a Merced emergency department and then transferred. Each step creates a separate chart, a separate bill and sometimes a separate transport charge. All of it belongs in your claim.
Getting a Merced Police Department Report
If the crash happened on a city street and Merced police responded, the department’s Records unit at the main station, 611 West 22nd Street, sells police reports for 10 cents a page. You can also request a report by mail by sending a letter with 50 cents per report and a self-addressed stamped envelope. A request on someone else’s behalf, such as from a lawyer, needs a signed authorization from that person.
Deadlines Under California Law
California’s general deadline to sue for a personal injury caused by someone else’s negligence is two years from the injury, under Code of Civil Procedure section 335.1. If a public agency’s vehicle was involved, such as a county truck or a transit bus, or if a road condition maintained by Caltrans or the county contributed, Government Code section 911.2 requires a written claim within six months.
Vehicle Code section 16000 also requires a driver in an injury crash, or one causing more than $1,000 in property damage, to report it to the DMV within 10 days.
Where a Merced Truck Case Is Filed
The Superior Court of Merced County handles both limited and unlimited civil cases at the Old Merced Courthouse, the 21st Street building at 627 West 21st Street. Its Civil Division takes pleadings at the Civil Clerk’s Office in that building. A lawsuit against an out-of-state carrier may sometimes be heard in federal court, which is decided case by case.
Frequently Asked Questions
Who investigates a truck crash on Highway 99 near Merced?
The California Highway Patrol’s Merced Area office, based in Atwater at 1500 Bell Drive, patrols about 43 miles of State Route 99, from the Stanislaus County line to the Madera County line, along with State Routes 59, 140 and 165. A crash on any of those roads is usually investigated by CHP officers from that office. To get the report, complete form CHP 190 and submit it in person or by mail. If the crash happened on a city street such as G Street or Olive Avenue, the Merced Police Department may have taken the report instead.
Do federal hours-of-service rules apply to farm trucks in Merced County?
Not always. Under 49 CFR 395.1(k), the federal hours-of-service rules do not apply during planting and harvesting periods, as set by each state, to drivers hauling agricultural commodities within 150 air miles of their source, and to certain farm-supply and livestock trips. The exemption covers hours limits, not safe driving. A farm truck driver still has to obey traffic laws, and the owner still has to maintain the vehicle and avoid overloading it. In these cases we rebuild the driver’s day from other records, such as weigh tickets, dispatch texts, delivery logs and phone data.
Where will I be taken if I am seriously injured in a Merced truck crash?
Merced County has no designated trauma center, according to a March 2026 Central Valley Journalism Collaborative report. Seriously injured patients are often transferred to the adult Level II trauma centers in Modesto, Memorial Medical Center and Doctors Medical Center, about 45 minutes away, or to Community Regional Medical Center in Fresno, the valley’s only Level I trauma center. Some people are treated first at a Merced emergency department. Ask for the records from each hospital and each ambulance transport, since those bills are part of your damages.
How do I get a Merced Police Department collision report?
The Merced Police Department’s Records unit is at the main police station, 611 West 22nd Street. Reports cost 10 cents per page when you buy them in person. To request one by mail, send a letter with 50 cents per report and a self-addressed stamped envelope to the department’s Records unit. If someone is requesting the report for you, such as your lawyer, include a signed authorization from you. Call the Records unit first if you are unsure whether the city police or the CHP handled your crash, since freeway crashes on Highway 99 usually go to the CHP.
Where is a truck accident lawsuit filed in Merced County?
The Superior Court of Merced County lists its civil limited and civil unlimited offices at the Old Merced Courthouse, also called the 21st Street building, at 627 West 21st Street. Pleadings in civil matters are filed with the Civil Clerk’s Office there. Truck injury claims seeking more than the limited-civil amount are unlimited civil cases. If the trucking company is based in another state, the case could be eligible for federal court instead, which depends on the parties and the amount in dispute.
How long do I have to bring a claim after a truck crash in Merced?
For a claim against a private trucking company or driver, Code of Civil Procedure section 335.1 sets a two-year deadline from the date of the injury. A claim involving a public entity, such as a county vehicle, a transit bus or a dangerous condition on a state highway, needs a written government claim within six months under Government Code section 911.2. Wrongful death claims generally run two years from the date of death. Records from the carrier can disappear long before those deadlines, so it helps to act early even when the deadline is months away.
